Consumer Health Data Privacy Notice
This notice describes how Biomarker Health handles consumer health data — information that identifies your past, present, or future physical or mental health status — where that data is not already covered by HIPAA. It supplements, and does not replace, our Privacy Policy and our HIPAA Notice of Privacy Practices.
Most information we hold about patients is protected health information governed by HIPAA and by the HIPAA Notice. This notice matters chiefly for information collected before you become a patient, and for residents of states whose consumer health data laws apply regardless of HIPAA status.
Categories of consumer health data we collect
- Information you enter when booking or creating an account, including the health goals and symptoms you describe.
- Biomarker and laboratory results generated through our panels, and past results you choose to upload.
- Information about the care you receive, including protocols, prescriptions, and appointment history.
How we use it
To provide care and operate the practice: ordering and interpreting labs, building and adjusting your protocol, scheduling, and communicating with you about your care.
Who we share it with
- The clinicians involved in your care.
- Laboratories and pharmacies necessary to fulfil an order your clinician places.
- Service providers that process data on our behalf under written agreements restricting their use of it.
- Where required by law.
We do not sell consumer health data. We do not share it with advertisers, data brokers, or insurers.
Your rights
Subject to verification of your identity, you may request to:
- Confirm whether we hold consumer health data about you, and access it.
- Obtain a list of the third parties with whom we have shared it.
- Withdraw consent to its collection and sharing.
- Have it deleted, including by any service provider holding it on our behalf.
Exercising these rights will not cause us to deny you care or charge you a different price. Note that some records must be retained for a period set by medical records law even after a deletion request; where that applies we will tell you.
